The TN Visa
The TN Visa is a temporary visa for employment in the United States. It is available to
Canadian citizens working in certain specified professions.
Prospective employment in the United States for which the visa applicant is
qualified is a pre-requisite.
The TN Visa is not a permanent visa, and, thus, it should not be confused with
what is commonly referred to as a "Green Card."
The TN Visa is a one year visa, valid for twelve months from issuance.
The TN Visa can, however, be renewed year in and year out on a multiple
basis, without limitation.
The TN Visa holder is not required to maintain an abode outside of the
United States whilst in the country on a TN Visa.
The TN Visa may include the principal visa holder and his or her immediate
family. Spouse and children are not allowed to work in the United States.
Minor children so included in the visa are allowed to attend school in the
United States.
There are no travel restrictions on a TN Visa per se.
Any individual on a TN Visa in the United States is expected to and will
pay US Income Tax.
At the conclusion of the TN Visa period of validity, unless otherwise extended
or renewed, the TN Visa holder and his or her family are expected to return to
their country of origin.
The TN Visa is not in any way an exclusive visa, meaning that a holder of
such a visa is not thereby excluded from at any time obtaining any other
visa for which he or she is eligible, including other temporary visas and /
or even a permanent residency visa.
Occupations that qualify for TN Visa consideration are set forth in the
TN Visa Schedule. (See Schedule)
If an individual's occupation is not on the Schedule, or he applicant is
not a Canadian citizen, then, the TN Visa is not the appropriate visa,
and attention should be directed to one of the other available temporary
visas.
